As part of the agency’s efforts to increase efficiency, U.S. Citizenship and Immigration Services (USCIS) has announced that premium processing will be available for certain pending Forms I-140, Immigrant Petitions for Alien Workers, under the EB-1 multinational executive or manager and EB-2 members of professions with advanced degrees or exceptional abilities seeking a national interest waiver (NIW) classifications. At this time, USCIS will not allow premium processing requests under these categories at the time the petition is initially filed. Petitioners wishing to request a premium processing upgrade must file Form I-907, Request for Premium Processing Service, on or after the effective date:
- Beginning June 1, 2022, USCIS will accept premium processing upgrade requests for pending EB-1 multinational executive or manager petitions filed on or before January 1, 2021
- Beginning July 1, 2022, USCIS will accept premium processing upgrade requests for:

- Pending EB-1 multinational executive or manager petitions filed on or before March 1, 2021; and
- pending NIW petitions filed on or before June 1, 2021

USCIS published a new version of Form I-907, dated 05/31/22, which will be the only accepted version starting on July 1, 2022. The premium processing timeframe for USCIS to take action on EB-1 multinational executive or manager and EB-2 NIW cases will be 45 days, starting on the date USCIS receives all prerequisites for adjudication. At the time of implementation, the premium processing filing fee for these two classifications will be $2,500.
