A Mechanical Engineer from Jordan hired the Law Office of Young Ah Ri, PC to build a customized NIW petition. Once we carefully examined the engineer’s credentials, we knew that the case would require a more abstract construction to be successful because all of the engineer’s academic and practical contributions to the field were owned by the employer. Thus, disclosure of the contributions would be a violation of intellectual property laws.

We began by highlighting the client’s education, experience and special skills. We demonstrated to USCIS that our client’s work in the field of Reliability Engineering should not be measured based on the typical contributions, such as publications in journals and conference proceedings. Rather, we argued that the engineer’s contributions should be viewed based upon the practical effect of her work; using concrete statistics to show the economic gains and improved safety at the place of employment and in the local community. Our approach was effective, as the case was approved without a Request for Evidence.
