Extended Green Card Validity for Conditional Permanent Residents

The processing times for Form I-751, Petition to Remove Conditions on Residence and Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status have increased over the past year.  In an attempt to assist conditional permanent residents dealing with these delays, U.S. Citizenship and Immigration Services (USCIS) announced that it is extending the validity of green cards for petitioners with properly filed Forms I-751 or I-829 for 48 months beyond the card’s expiration date.

This change went into effect on January 11, 2023 for Form I-829 and will go into effect on January 25, 2023 for Form I-751.  USCIS will issue receipt notices reflecting this change for newly filed Forms I-751 and I-829.  Additionally, USCIS will issue new receipt notices with updated language regarding the 48 month extension for currently pending Forms I-751 and I-829.  These receipt notices can be presented with an expired green card as evidence of continued status, as proof of work authorization, and for travel purposes for 48 months from the expiration date listed on the green card.
