Challenges to USCIS Fee Schedule

On September 29, 2020, a federal judge stayed the implementation and the effective date of the August 2020 Final Rule, which changed the fee schedule and required new editions of several forms, pending the final decision of the matter. (ILRC et al., v. Wolf, et al., 9/29/20)

This means that the increased fees, as well as the form and policy changes related to the USCIS Fee Rule, cannot be implemented by USCIS at this time. That being said, petitioners and applicants will not be subject to higher fees or new editions of the forms outlined in the regulation. The USCIS website does not reflect the update, but it is expected that an update concerning the new editions of the forms will be made in the coming days.

To our dismay, it is impossible to say with certainty how long the rule will remain enjoined. The government has up to 60 days to appeal the decision.
